This document expands on Article 4 (Sale, promotion and rental) and Article 5 (Sales by MatchFighterX) of the General Terms & Conditions.
Article 1 - Applicability
These terms apply to all purchases of Products via MatchFighterX, both where MatchFighterX itself sells (Article 5 of the General Terms & Conditions) and where another User (gym, sponsor, supplier or reseller) sells, promotes or rents via the Platform (Article 4 of the General Terms & Conditions).
Article 2 - Two types of sellers
2.1 Sales by MatchFighterX itself
Where a Product is sold and delivered by MatchFighterX, MatchFighterX is the selling party and the provisions in this document apply directly towards MatchFighterX.
2.2 Sales by third parties on the Platform
Where a Product is sold, promoted or rented by another User, MatchFighterX acts solely as a platform. The selling User is the contracting party and is fully responsible for pricing, quality, delivery, warranty and correctly applying the right of withdrawal. For those transactions MatchFighterX is not a party to the agreement and accepts no liability, in accordance with Article 4.3 of the General Terms & Conditions.
Article 3 - Prices and payment
3.1 All stated prices are in the currency shown on the Platform and, where applicable, include VAT.
3.2 Payment takes place via the payment methods available on the Platform, before or on delivery, depending on the chosen option.
3.3 For third-party sales, the selling User may apply their own (additional) payment and delivery terms, which are stated separately with the Product or order.
Article 4 - Delivery
4.1 The selling party (MatchFighterX or the relevant User) endeavours to deliver Products within the stated period.
4.2 Exceeding a delivery period does not in itself give a right to compensation, unless otherwise required by law.
4.3 The risk of damage to or loss of the Product passes to the buyer at the moment of delivery.
Article 5 - Right of withdrawal (returns)
5.1 If you buy a physical Product online as a consumer in the EU, you generally have the statutory right to cancel the agreement within 14 days of receipt without giving reasons (right of withdrawal).
5.2 To exercise this right, notify us within the period via support@MatchFighterX.com or via the return process for the relevant order, and return the Product in accordance with the instructions.
5.3 The costs of return shipping are for the buyer, unless otherwise stated with the Product.
5.4 After a valid, timely notice, the purchase amount (including standard shipping costs) is refunded within 14 days after the Product has been received back or proof of return shipment has been provided.
5.5 Exceptions to the right of withdrawal - the right of withdrawal does not apply, among other things, to:
- Digital products and licences where delivery has started with express prior consent and where the right of withdrawal has been waived;
- Products that for hygiene reasons are not suitable for return after the seal has been broken (e.g. certain protective equipment, mouthguards, underwear);
- Custom-made or personalised Products;
- Admission tickets for galas and events with a fixed date;
- Subscriptions after the statutory cooling-off period has ended or once the service has been fully performed with the User's consent.
5.6 For third-party sales, the selling User is responsible for correctly offering and handling the right of withdrawal in accordance with the law; MatchFighterX does not actively supervise this but may mediate in disputes.
Article 6 - Warranty and conformity
6.1 Products must conform to the agreement (conformity) and the characteristics the buyer may reasonably expect.
6.2 For Products sold by MatchFighterX itself, the statutory warranty applies; any additional warranty is stated with the Product.
6.3 For Products sold by third parties, the warranty stated by that selling User applies; that User remains responsible for fulfilling it, see Article 4.2 of the General Terms & Conditions.
6.4 Complaints about a Product should be reported as soon as possible, with proof of purchase, to the selling party.
Article 7 - Subscriptions
For the purchase, cancellation and automatic renewal of subscriptions, Article 6 of the General Terms & Conditions applies.
Article 8 - Complaints and disputes
8.1 Complaints about an order can be reported via support@MatchFighterX.com.
8.2 If a complaint about a third-party Product is not resolved with the selling User, you may report this to MatchFighterX, which may mediate but is not liable for the underlying transaction.
8.3 These terms are governed by Dutch law and the Dutch courts have jurisdiction, in accordance with Article 12 of the General Terms & Conditions.
