Article 1 - Definitions
1.1 MatchFighterX is the digital combat sports platform, operated by MatchFighterX, a sole proprietorship established in the Netherlands.
1.2 Platform means the website, app and all related digital services of MatchFighterX through which Users connect with each other and through which services, subscriptions, Products and galas are offered.
1.3 User means any person or organisation that registers with or uses MatchFighterX.
1.4 Role includes, among others: fighter, coach, gym, organiser, referee, photographer, sponsor, supplier or reseller.
1.5 Products means all physical and digital sports goods, clothing, accessories, licences and services sold or offered through MatchFighterX.
Article 2 - Applicability
2.1 These terms apply to all services, subscriptions, sales, rentals, promotions and galas via MatchFighterX worldwide.
2.2 By using the Platform, the User agrees to these terms.
2.3 In addition to these General Terms & Conditions, the Privacy Policy, Cookie Policy, Disclaimer and Sales & Returns Terms also apply. In case of conflict, the order described in Article 18 (Order of documents) applies.
Article 3 - Nature of the Platform
3.1 MatchFighterX is primarily a platform that connects fighters, coaches, gyms, organisers, referees, photographers, sponsors, suppliers and resellers.
3.2 To the extent Users enter into agreements with each other (for example a sale, rental, sponsorship or participation in a gala organised by a third party), MatchFighterX acts as an intermediary/platform and is not a party to that agreement, unless explicitly stated otherwise (such as for sales by MatchFighterX itself, Article 7, or galas organised by MatchFighterX itself, Article 9).
Article 4 - Registration and roles
4.1 Each role has its own subscription type.
4.2 The User must provide accurate and up-to-date information.
4.3 MatchFighterX may block accounts in case of misuse or incorrect information.
Article 5 - Minors and age limits
5.1 Registration on the Platform is open to everyone, regardless of age.
5.2 Actual participation in fights (training bouts, matches and galas as a fighter) is only permitted from the age of 10.
5.3 For registration and for participation in fights by a minor (under 18 years), prior written consent of a parent or legal guardian is required. For subscriptions, the parent/legal guardian must make the payment, in accordance with Article 8.
5.4 The parent/legal guardian remains responsible for all activities of the minor on the Platform and during fights, matches and galas.
5.5 Organisers and gyms that allow minor fighters to participate are themselves responsible for verifying age and required consent, without prejudice to the parent/legal guardian's own responsibility.
Article 6 - Sale, promotion and rental by Users
6.1 Certain roles (such as gyms, sponsors and suppliers) may sell, promote or rent products within MatchFighterX.
6.2 The User is fully responsible for the quality, pricing, delivery and warranty of their own products or services.
6.3 MatchFighterX accepts no liability for products offered by third parties through the Platform.
6.4 The Sales & Returns Terms apply to withdrawal/returns for purchases.
Article 7 - Sales by MatchFighterX itself
7.1 MatchFighterX also sells and distributes sports products, clothing, accessories and licences itself.
7.2 Delivery terms, right of return and warranty for these products are stated separately with the product or order and are further detailed in the Sales & Returns Terms.
Article 8 - Subscriptions and payment
8.1 Subscriptions are role-specific and non-transferable.
8.2 Payment takes place via the methods available on the Platform.
8.3 Subscriptions renew automatically unless cancelled in time.
Article 9 - Gala organisation and insurance
9.1 Galas may be organised by external organisers using the Platform and, in the future, by MatchFighterX itself.
9.2 Organisers must have a valid organiser subscription and comply with additional gala rules (separate document).
9.3 Obtaining appropriate gala insurance (including liability and accident insurance for participants, fighters and audience) is and remains solely the responsibility of the organising party. This also applies where MatchFighterX itself acts as organiser: MatchFighterX then arranges insurance for that specific gala, but is and remains not liable for bodily injury under Article 13.
9.4 MatchFighterX does not verify whether every organiser is actually insured and accepts no responsibility towards participants or third parties in this regard.
Article 10 - Media and rankings
10.1 All rankings, results, photos and videos published via MatchFighterX may be used by MatchFighterX for promotion and archiving.
10.2 Users uploading media grant a royalty-free licence to MatchFighterX.
Article 11 - Intellectual property
11.1 All rights to the name, logo, design, software and other content of the Platform (except media uploaded by Users, see Article 10) belong to MatchFighterX.
11.2 It is not permitted to copy, distribute or otherwise use parts of the Platform without prior written consent of MatchFighterX.
Article 12 - Privacy and GDPR
12.1 MatchFighterX processes personal data in accordance with GDPR/AVG.
12.2 More information is available in the Privacy Policy on the Platform.
Article 13 - Liability
13.1 MatchFighterX is not liable for bodily injury, losses or damage occurring during training, matches or galas, whether organised by MatchFighterX itself or by a third party.
13.2 The User accepts all risks associated with combat sports activities.
13.3 To the extent not already excluded in 13.1, MatchFighterX liability for other damage (including Platform outages, data loss or loss of income) is limited to the amount paid by the User to MatchFighterX in the 12 months preceding the damaging event, with a maximum of EUR 500, unless there is intent or deliberate recklessness by MatchFighterX.
13.4 MatchFighterX is never liable for indirect damage, including consequential loss, loss of profit and lost savings.
Article 14 - Force majeure
14.1 MatchFighterX is not obliged to perform any obligation if prevented by force majeure, including failures at hosting parties or payment providers, internet outages, power failures, government measures and other circumstances beyond its reasonable control.
14.2 During force majeure, MatchFighterX obligations are suspended. If force majeure lasts longer than 30 days, both parties may terminate the agreement without compensation to each other.
Article 15 - Changes to these terms
15.1 MatchFighterX may amend these terms from time to time.
15.2 Material changes are announced in advance on the Platform and/or by email, with a reasonable period before they take effect.
15.3 Continued use of the Platform after amended terms take effect constitutes acceptance of those terms.
Article 16 - Termination of accounts
16.1 The User may terminate their account at any time via the Platform or by contacting support@MatchFighterX.com. Article 8 applies to ongoing subscriptions.
16.2 MatchFighterX may suspend or terminate an account for misuse, incorrect information or breach of these terms, as also described in Article 4.3.
16.3 Upon account termination, the right to offer products or services through the Platform ends; agreements already concluded with other Users remain in force.
Article 17 - Complaints
17.1 Complaints about the Platform or MatchFighterX itself can be submitted via support@MatchFighterX.com. MatchFighterX aims to respond within a reasonable period.
17.2 Complaints about Products or services of other Users are handled primarily via the Sales & Returns Terms.
17.3 Parties will make efforts to resolve complaints amicably before submitting a dispute to the court.
Article 18 - Order of documents
In case of conflict between documents, the following order applies from highest to lowest: (1) any separate written agreement with MatchFighterX, (2) these General Terms & Conditions, (3) the Sales & Returns Terms, (4) the Privacy Policy and Cookie Policy, (5) the Disclaimer.
Article 19 - Severability
If any provision of these terms is null or voidable, the remaining provisions remain fully in force. The parties will replace the invalid provision with one that most closely reflects the original intent.
Article 20 - Governing law and disputes
20.1 These terms are governed by Dutch law.
20.2 For Users who are consumers residing in another EU country, notwithstanding this choice of law, mandatory consumer protection rules of their country of residence may remain applicable.
20.3 Disputes shall be handled by the competent court in the Netherlands, without prejudice to a consumer's right to submit a dispute to the court of their own place of residence where mandatory law so provides.
